General terms and conditions of online sale of Lucy 3D Lab

In this document, “Lucy 3D Lab”, “we”, “us” or “our” refers to Lucy 3D Lab di Lucia Infantozzi. “Customer” means the natural or legal person who browses the website, creates an account or purchases products through the website.
2. SCOPE OF APPLICATION
These Terms and Conditions govern access to and use of the website www.lucy3dlab.it, browsing the online store, creating customer accounts, submitting orders and purchasing the products offered by Lucy 3D Lab.
By placing an order on the website, the Customer declares that they have read and accepted these Terms and Conditions, the Privacy Policy, the Cookie Policy, the Shipping and Delivery Policy and the Returns and Refunds Policy, where published on the website.
In the event of a conflict between these Terms and Conditions and the specific conditions stated on the product page, the more specific conditions on the product page shall prevail, provided they comply with applicable legislation.
3. GEOGRAPHICAL SALES AREA
Lucy 3D Lab sells through the website exclusively in Italy and European Union countries.
Orders from non-EU countries, the United Kingdom, Switzerland or other territories outside the European Union may be refused, cancelled or processed only subject to a specific written agreement before payment or dispatch.
4. CONSUMER CUSTOMERS AND PROFESSIONAL CUSTOMERS
The website may be used by consumers as well as professionals, businesses, breeders, resellers or persons purchasing in the course of their profession, trade, craft or business.
“Consumer” means a natural person purchasing for purposes outside any trade, business, craft or profession they may engage in.
“Professional Customer” means a person or entity purchasing in the course of their profession, trade, craft or business, including when providing business tax details, a VAT number, a recipient code or a PEC address for invoicing purposes.
The mandatory provisions of the Italian Consumer Code apply exclusively to Consumer Customers. Relationships with Professional Customers are governed by these Terms and Conditions and, for matters not covered herein, by the Italian Civil Code and applicable Italian legislation.
5. WEBSITE ACCESS AND CUSTOMER ACCOUNT
The Customer may browse the website without creating an account, although certain functions may require registration or authentication.
The Customer undertakes to provide truthful, complete and up-to-date details, including their email address, billing details, shipping details, telephone number and any other information required to process the order correctly.
The Customer is responsible for the security of their account credentials and for activities carried out through that account. In the event of unauthorised use or suspected unauthorised access, the Customer must promptly contact Lucy 3D Lab.
Lucy 3D Lab may suspend or restrict access to the account in the event of fraudulent use, a breach of these Terms, a breach of the law or conduct capable of harming the website, the business or other users.
6. NATURE OF THE PRODUCTS SOLD
Lucy 3D Lab primarily manufactures and sells 3D-printed accessories and artisanal products intended for reptile setups, terrariums, boxes, racks, modified containers and similar configurations.
Products may include, by way of example:
· internal supports, climbing structures and layout accessories;
· air vents, clips, closures, supports, bowls and 3D-printed components;
· doors with glass and mounting structures;
· accessory kits for compatible containers;
· boxes or containers purchased from third-party suppliers and manually modified with 3D-printed accessories.
Unless otherwise stated on the product page, animals, external containers, furnishings, substrates, plants, branches, heating systems, monitoring instruments and any other elements shown for demonstration purposes are not included.
The products are not toys, medical devices, veterinary devices or food products, and are not intended for use by children.
7. PERSONALISED PRODUCTS
Personalised, made-to-measure products or products made to the Customer’s specific requirements cannot be ordered directly through the standard Shopify catalogue, unless otherwise stated.
Personalisation requests must be submitted by private communication, email or another channel indicated by Lucy 3D Lab. Lucy 3D Lab will assess technical feasibility, timescales, price and specific conditions before any order confirmation.
A product is considered personalised when it is made according to dimensions, colours, configurations, adaptations, modifications or specific requirements requested by the Customer that differ from the standard variants normally available in the catalogue.
For goods made to the Customer’s specifications or clearly personalised, the Consumer’s right of withdrawal may be excluded within the limits provided for by applicable legislation.
8. 3D-PRINTED PRODUCTS AND ARTISANAL CHARACTERISTICS
Lucy 3D Lab products are manufactured using 3D printing processes and/or artisanal manual modifications. Consequently, they may exhibit slight aesthetic variations between individual items, including minor differences in colour, surface finish, layer lines, small manufacturing marks, dimensional tolerances or slight variations in the position of manually fitted accessories.
These characteristics are inherent in the artisanal manufacturing process and do not constitute a product defect if they do not compromise functionality, safety and conformity with the published description.
The measurements stated on the product pages are nominal measurements. Minor tolerances may occur due to the 3D printing process, the material used, finishing and manual assembly.
9. MANUALLY MODIFIED BOXES AND THIRD-PARTY TRADEMARKS
Some products may be made using base containers, boxes or accessories purchased from third-party suppliers and subsequently modified manually by Lucy 3D Lab.
In these cases, Lucy 3D Lab does not manufacture the base container, but transforms it through manual modifications, cutting, drilling and the installation of air vents, doors, clips, supports or other 3D-printed accessories.
Through these modifications, the box is transformed into a practical, lightweight terrarium suitable for setups intended for reptiles, arachnids, amphibians, insects, crustaceans or small invertebrates compatible with the characteristics of the container, ventilation, closure, materials and available internal dimensions.
Any references to third-party trademarks, models or trade names, such as IKEA, Samla, Braplast, Leroy Merlin or other similar names, are used solely to identify the base container, dimensional compatibility or type of modified product. Such references do not imply any collaboration, authorisation, sponsorship, approval or official affiliation between Lucy 3D Lab and the owners of the trademarks mentioned.
The Customer may purchase an already modified box, when available, or separately purchase the 3D-printed accessories listed on the website and fit them independently to a container with compatible dimensions, structure, thickness and mounting space.
10. INTENDED USE, COMPATIBILITY AND CUSTOMER RESPONSIBILITY
Products must be used exclusively for the purpose stated on the product page and in accordance with the instructions, warnings and technical limits provided.
The Customer is responsible for verifying the product’s compatibility with:
· the animal species housed;
· the animal’s size, weight, strength and behaviour;
· the temperature, humidity and conditions of the setup;
· the dimensions of the container or terrarium;
· the presence of heat sources, lamps, heat mats, heating cables or other devices;
· any risks of escape, entrapment, ingestion, breakage, falling or crushing.
Products must not be used with large animals, particularly strong animals or animals capable of forcing, breaking, lifting, biting or damaging the product, unless the product page expressly indicates specific compatibility.
The animal’s size must always be compatible with the available internal space. Use with species not indicated, oversized animals, particularly strong animals or incompatible environmental conditions is the Customer’s responsibility.
The information provided on the product pages does not replace the assessment of the breeder, a veterinarian experienced in exotic animals or a qualified professional.
11. MATERIALS, TEMPERATURES AND LIMITATIONS OF USE
The materials used are indicated on the individual product pages. Many products are made from PETG, PLA, PLA+ or other plastics suitable for 3D printing, as specified on the product page.
Unless otherwise stated on the product page, products printed in PETG or PLA/PLA+ must not be exposed to temperatures exceeding the limits stated on the product page, direct heat sources, open flames, lamps positioned too close, overheated surfaces, dishwashers, high-temperature sterilisers or environments that may deform the material.
The Customer must always ensure that the product is not positioned in areas of the terrarium or box where the temperature may exceed the stated operating limits.
12. PRODUCT SAFETY, IDENTIFICATION AND REGULATION (EU) 2023/988 (GPSR)
Lucy 3D Lab acts as the manufacturer, artisanal modifier or seller of products placed on the market through the website.
For products subject to Regulation (EU) 2023/988 on general product safety, Lucy 3D Lab provides, where necessary, information useful for identifying the product, the manufacturer, the intended use, materials, warnings and safety instructions on the product pages, on the packaging, on the product, by means of a label, SKU code or batch number, or in the accompanying documentation.
The Customer must carefully read all safety information before use. In particular:
· keep products out of the reach of children;
· do not use products as toys;
· periodically check integrity and stability, and inspect for cracks, deformation, sharp parts, loose screws or signs of wear;
· do not use products that are damaged, deformed or no longer stable;
· do not modify the product in ways not intended;
· do not expose the product to temperatures higher than those stated;
· avoid direct contact with flames, lamps positioned too close or intense heat sources;
· wash by hand with lukewarm water and mild detergents, unless otherwise stated;
· do not wash in a dishwasher, boil or sterilise at high temperatures, unless otherwise stated;
· if in doubt about the product’s safety, stop using it and contact Lucy 3D Lab.
The Customer is asked to retain any labels, instructions, SKU codes, batch numbers, packaging or accompanying documentation received with the product, as these may be useful for assistance, guarantee claims, traceability and product safety.
The Customer is asked to promptly report any incidents, near misses, abnormal breakage, safety issues or defects identified by writing to admin@lucy3dlab.it and providing the order number, SKU, batch number if present, photographs of the product, a description of the problem and how the product was used.
13. ORDERS AND CONCLUSION OF THE CONTRACT
To purchase a product, the Customer must select the desired products, add them to the cart, check the order summary, enter the required details, choose the payment method and confirm the order.
Before submitting the order, the Customer has the opportunity to check and correct any errors in the details entered, selected products, quantities, shipping address and billing details.
By submitting the order, the Customer makes an offer to purchase the selected products. The contract is considered concluded when the Customer receives order confirmation from the Shopify system or Lucy 3D Lab at the email address provided, except in the event of obvious errors, subsequent unavailability, objective inability to manufacture or other unforeseeable impediments.
In the event of an obvious error in the price, availability, product description or shipping costs, Lucy 3D Lab will contact the Customer to propose correcting the order or cancelling it with a full refund of any amounts already paid.
Lucy 3D Lab reserves the right to refuse or cancel orders in the event of:
· incomplete, incorrect or unverifiable details;
· suspected fraud or unauthorised use of payment instruments;
· inability to ship to the address provided;
· unavailability of the product or required material;
· a request for a product incompatible with safety requirements or applicable legislation;
· a breach of these Terms.
14. AVAILABILITY, PRODUCTION AND PREPARATION TIMES
Many Lucy 3D Lab products are manufactured, completed, assembled or modified after the order is received. The quantities shown on the website may represent the ability to order the product and do not necessarily indicate that finished items are immediately available in stock.
Unless otherwise stated on the product page or checkout page, products may require up to 7 working days for production, preparation, quality control and packaging.
For organisational reasons and to reduce the risk of parcels remaining in storage for extended periods over the weekend, Lucy 3D Lab may primarily dispatch orders on Mondays, Tuesdays and Wednesdays. Orders ready after these days may be handed over to the carrier on the next available shipping day.
Production and preparation times are separate from the carrier’s transit times.
15. PRICES, PAYMENTS AND TAX DOCUMENTATION
All prices are stated in euros (€).
The final order price, including products, any shipping costs and other applicable charges, is displayed to the Customer before the order is confirmed.
Lucy 3D Lab operates under the flat-rate tax regime, subject to subsequent changes. Under this regime, where applicable, VAT is not charged in accordance with the tax rules governing the flat-rate tax regime. The appropriate tax wording will appear on the tax documents issued, in accordance with current legislation and the tax adviser’s instructions.
Shipping costs, any surcharges, packaging costs or other ancillary charges are indicated before the order is confirmed.
For shipments within the European Union, any taxes, local charges or costs required by the authorities of the destination country, where applicable, are borne by the Customer, unless otherwise stated or required by mandatory provisions of law.
The available payment methods are those indicated at checkout. Lucy 3D Lab may change, add or remove payment methods at any time.
The Customer warrants that they are authorised to use the selected payment method.
Tax documentation is issued in accordance with applicable legislation. Customers requiring an invoice or tax documentation containing specific details must correctly enter the required information when placing the order, including their VAT number, tax code, recipient code or PEC address, where applicable.
16. SHIPPING AND DELIVERY
Lucy 3D Lab ships orders to the address provided by the Customer at the time of purchase. The Customer is responsible for the accuracy and completeness of the address provided.
Delivery times stated on the website or communicated by email are estimates based on the carrier’s average transit times and do not necessarily include the product’s production or preparation time.
For Consumer Customers, the risk of loss of or damage to the goods passes to the Customer only when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the goods, except where the Customer has independently chosen a carrier not offered by Lucy 3D Lab.
Upon delivery, the Customer is asked to check the integrity of the packaging. If the parcel is visibly damaged, open, wet or tampered with, the Customer must, where possible, accept delivery with a specific reservation or refuse delivery and promptly contact Lucy 3D Lab with photographs of the packaging and product.
Any delivery problems, failed delivery, parcels being held in storage, incorrect addresses or inability to deliver must be promptly reported to admin@lucy3dlab.it.
If the parcel is returned to the sender due to an incorrect address provided by the Customer, repeated absence, failure to collect a parcel held in storage or another cause attributable to the Customer, Lucy 3D Lab may require payment of the new shipping costs for a second dispatch, without prejudice to the Consumer’s mandatory rights.
17. RIGHT OF WITHDRAWAL FOR CONSUMER CUSTOMERS
The Consumer Customer has the right to withdraw from the contract within 14 days of the day on which they receive the product, subject to the exceptions provided for by law.
To exercise the right of withdrawal, the Customer must contact Lucy 3D Lab at admin@lucy3dlab.it, providing the order number, first name and surname, the product purchased and their intention to withdraw.
The Consumer is not required to state the reason for withdrawal. Lucy 3D Lab may ask for the reason for the return on a voluntary basis to improve products, assistance and quality control.
The Customer must wait for return instructions before dispatching the product. Lucy 3D Lab will communicate the return address only after receiving the withdrawal or return request and providing the operational instructions. The request to wait for instructions is intended to prevent incorrectly addressed shipments, losses and handling problems, without limiting the Consumer’s mandatory rights.
The Customer must return the product without undue delay and in any event within 14 days of communicating their withdrawal, following the instructions received from Lucy 3D Lab.
Unless otherwise stated or required by law, the direct costs of returning the product are borne by the Customer. In the event of valid withdrawal, Lucy 3D Lab will refund the product price and the initial standard delivery costs, if paid by the Customer, while any supplementary costs arising from the Customer’s choice of a more expensive delivery method than the standard delivery offered will not be reimbursed.
The product must be returned complete, clean and intact, with any accessories, instructions, seals, labels, product packaging and shipping packaging, where present.
The Customer is responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
For hygiene, health and safety reasons, using the product inside terrariums, boxes, racks or environments in contact with animals, substrates, faeces, urine, water, live food, insects, mould, bacteria, parasites, detergents or other contaminants may diminish the value of the goods. Where the product is used, contaminated, damaged, modified, deformed or no longer resalable in a safe condition, Lucy 3D Lab may reduce the refund in proportion to the diminished value, within the limits permitted by law.
The refund will be made using the same payment method used by the Customer for the order, unless otherwise agreed. Lucy 3D Lab may withhold reimbursement until it receives the returned goods or until the Customer provides evidence of having dispatched them, in accordance with applicable legislation.
18. SEALS, OPENED PRODUCTS AND LIMITATIONS ON WITHDRAWAL FOR HYGIENE REASONS
Some products may be delivered with seals, closures, tamper-evident labels or sealed packaging, where compatible with the product’s dimensions and nature.
If a product is sealed and is unsuitable for return after opening for health protection or hygiene reasons, removing or breaking the seal may result in the exclusion of the right of withdrawal in the cases provided for by applicable legislation.
Seals are intended to protect the safety, hygiene, traceability and integrity of the product, particularly where the product may be intended for environments containing animals, terrariums, substrates or biological materials.
The exclusion of withdrawal for opened sealed products applies only where the conditions laid down by law are met and where this characteristic is consistent with the nature of the product.
19. EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply in the cases provided for by law, including, by way of example:
· goods made to the Customer’s specifications or clearly personalised;
· products made to the Customer’s specific requirements, particular dimensions, non-standard modifications, personalised colours or configurations not available as a regular catalogue option;
· sealed products that are unsuitable for return for health protection or hygiene reasons and have been opened after delivery, where this exclusion is applicable and clearly stated;
· other cases provided for by Article 59 of the Italian Consumer Code.
Simply choosing a regular variant offered in the catalogue does not automatically exclude the right of withdrawal, unless the product is actually made to measure or clearly personalised according to the Customer’s specific requirements.
20. RETURNS BY PROFESSIONAL CUSTOMERS
The right of withdrawal provided for by the Italian Consumer Code does not apply to Professional Customers.
Any returns, exchanges or cancellations requested by Professional Customers are subject to acceptance by Lucy 3D Lab, except in the event of defects, lack of conformity or other rights provided for by applicable law.
Professional Customers must not dispatch the product without prior written authorisation from Lucy 3D Lab. The return address will be communicated only after the request has been assessed.
21. LEGAL GUARANTEE OF CONFORMITY
The legal guarantee of conformity provided for by the Italian Consumer Code applies to Consumer Customers.
The guarantee covers any lack of conformity existing at the time of delivery that becomes apparent within the periods laid down by law. In the event of a lack of conformity, the Consumer is entitled to the remedies provided for by applicable legislation, including repair, replacement, a price reduction or termination of the contract, subject to the conditions and limits laid down by law.
The guarantee does not cover defects, breakage or damage caused by:
· improper use or use other than the intended use;
· incorrect assembly not attributable to incorrect instructions provided by Lucy 3D Lab;
· exposure to temperatures exceeding the stated limits;
· contact with direct heat sources, flames, lamps positioned too close or overheated surfaces;
· incorrect washing, dishwasher cleaning, boiling or high-temperature sterilisation not provided for;
· unauthorised modifications, drilling, cutting, gluing or other work;
· overloading, falls, impacts, bites, twisting, forced handling or the actions of incompatible animals;
· normal product wear;
· use with species, animal sizes or environmental conditions incompatible with the product.
To report a lack of conformity, the Customer must contact admin@lucy3dlab.it, providing the order number, a description of the problem, clear photographs or videos of the product and details of the conditions of use.
For Professional Customers, the guarantees provided for by the Italian Civil Code apply, unless otherwise agreed in writing.
22. PRODUCT INFORMATION, PHOTOGRAPHS AND DESCRIPTIONS
Lucy 3D Lab undertakes to describe products as accurately as possible. However, colours, finishes and visual appearance may vary depending on the monitor, device, lighting, screen settings, material batch and printing process.
Published images are for descriptive purposes and may show prototypes, examples of use, demonstration setups or products installed in settings not included in the sale.
Product pages may be updated, corrected or amended at any time to improve clarity, safety, regulatory compliance or the accuracy of the information.
23. ERRORS, INACCURACIES AND AVAILABILITY
The website may contain clerical errors, inaccuracies, typographical errors or outdated information relating to prices, availability, descriptions, images, delivery times or product characteristics.
Lucy 3D Lab reserves the right to correct errors or inaccuracies, update information, cancel orders affected by an obvious error and refund in full any amounts already paid.
24. PROHIBITED USES OF THE WEBSITE
The Customer undertakes not to use the website to:
· pursue unlawful, fraudulent or harmful purposes;
· violate national, European or international rules;
· transmit viruses, malware or malicious code;
· collect other users’ personal data;
· engage in spam, phishing, scraping or unauthorised automated activities;
· interfere with the operation of the website or Shopify systems;
· infringe the intellectual property rights of Lucy 3D Lab or third parties;
· submit offensive, defamatory, misleading or unlawful content.
Lucy 3D Lab may restrict or block access to the website in the event of unlawful use or use contrary to these Terms.
25. INTELLECTUAL PROPERTY
All content on the website, including texts, photographs, graphics, logos, layouts, descriptions, files, models, designs, images, videos, trademarks, trade names and informational materials, belongs to Lucy 3D Lab or the respective owners, where indicated.
Copying, reproducing, distributing, modifying, publishing, selling, reusing or exploiting the website’s content without written authorisation is prohibited, except for uses permitted by law.
References to third-party trademarks are used solely for descriptive or compatibility purposes or to identify the base product, without any affiliation with or approval by the respective owners.
26. REVIEWS, FEEDBACK AND CONTENT SUBMITTED BY THE CUSTOMER
The Customer may submit reviews, comments, photographs, reports or feedback, if the function is available.
The Customer warrants that the submitted content is lawful, truthful, non-defamatory, non-offensive, non-misleading and does not infringe third-party rights.
By submitting content to Lucy 3D Lab, the Customer authorises Lucy 3D Lab to use, reproduce and publish it on the website or business channels for management, assistance, service improvement, technical documentation, product safety or promotional purposes, in compliance with applicable privacy legislation.
Lucy 3D Lab may remove content deemed unlawful, offensive, irrelevant or contrary to these Terms.
27. THIRD-PARTY SERVICES AND SHOPIFY
The website is built and operated through the Shopify platform. Certain website, checkout, payment, shipping, communication and analytics functions may be provided by Shopify or other third-party providers.
Sales made through the website are concluded between the Customer and Lucy 3D Lab. Shopify provides the technical platform and certain related services, but is not the seller of Lucy 3D Lab products.
The use of third-party services may also be subject to the terms and privacy policies of the respective providers.
28. PRIVACY AND COOKIES
The processing of the Customer’s personal data is governed by the Privacy Policy published on the website.
The use of cookies and tracking tools is governed by the Cookie Policy and the cookie banner, where applicable.
To process orders, payments, shipments and customer service requests and fulfil tax obligations, Lucy 3D Lab may process the Customer’s personal data and disclose it to providers necessary for the operation of the service, such as the e-commerce platform, payment providers, carriers, tax advisers, customer support tools or other providers indicated in the Privacy Policy.
29. LIMITATION OF LIABILITY
Nothing in these Terms limits or excludes the mandatory rights granted to the Consumer under Italian and European legislation, including the right of withdrawal, the legal guarantee of conformity, product safety and protection against unfair contract terms.
To the extent permitted by law, Lucy 3D Lab is not liable for damage arising from improper use, incorrect installation, failure to verify compatibility with the animal, exposure to excessive heat, unauthorised modifications, lack of maintenance, use with incompatible animals or failure to comply with the instructions and warnings provided.
For Professional Customers, except in cases of wilful misconduct or gross negligence and subject to any other mandatory provisions of law, Lucy 3D Lab’s liability is limited to the value of the purchased product that caused the direct damage.
30. FORCE MAJEURE
Lucy 3D Lab is not liable for delays or failures to perform caused by events beyond its reasonable control, including major technical failures, sudden material shortages, carrier service disruptions, weather events, strikes, fires, flooding, power outages, interruptions to Shopify or payment provider services, measures imposed by authorities, public health emergencies or other force majeure events.
In such cases, Lucy 3D Lab will inform the Customer as soon as possible and propose, where applicable, a revised timescale, an alternative solution or a refund of the order.
31. CHANGES TO THE TERMS
Lucy 3D Lab may update these Terms and Conditions at any time to reflect legislative changes, operational changes, new website functions, new products or safety requirements.
The version applicable to the order is the version published on the website at the time the order is concluded, subject to any changes required by mandatory provisions of law.
32. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are governed by Italian law.
For Consumer Customers, the mandatory jurisdiction of the court of the Consumer’s place of residence or domicile remains unaffected, if located in Italy or a European Union Member State, in the cases provided for by applicable legislation.
For Professional Customers, unless otherwise required by mandatory provisions of law, the courts of the place where Lucy 3D Lab has its registered office shall have jurisdiction.
33. OUT-OF-COURT DISPUTE RESOLUTION
In the event of a dispute, the Customer may first contact Lucy 3D Lab at admin@lucy3dlab.it to attempt an amicable resolution.
The Consumer Customer may also use the alternative dispute resolution (ADR) mechanisms provided for by applicable legislation by contacting the competent bodies.
The former European ODR platform for online dispute resolution was discontinued as of 20 July 2025. The Customer may consult updated information on available ADR bodies through the relevant official channels.
Recourse to ADR mechanisms does not affect the Consumer’s right to bring proceedings before the competent court.
